DMCA & Copyright Policy

Drivesome respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and applicable copyright law. If you believe your copyrighted work has been posted on Drivesome without authorisation, please submit a formal takedown notice as described below.

Submitting a Takedown Notice

To file a valid DMCA takedown notice, your submission must include all of the following:

  1. Your full legal name and contact information (name, address, phone, email)
  2. A description of the copyrighted work you believe has been infringed
  3. The specific URL or location on Drivesome where the allegedly infringing material appears
  4. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law
  5. A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf
  6. Your electronic or physical signature

Upon receipt of a valid, complete notice, Drivesome will act expeditiously to remove or disable access to the identified material.

Counter-Notice

If you believe content was removed in error, you may submit a counter-notice containing the information required under 17 U.S.C. § 512(g)(3). Counter-notices should be submitted to the same address above.

Repeat Infringer Policy

Drivesome maintains a strict policy of terminating the accounts of users who are found to be repeat infringers of intellectual property rights.

False Claims

Submitting a false or bad-faith DMCA claim is a serious matter. Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing may be liable for damages, costs, and legal fees. Drivesome reserves the right to seek full recovery of costs and damages arising from any false or bad-faith claim submitted against this platform.

Legal Process for Third-Party Claims

If a copyright owner wishes to pursue legal action against an alleged infringing user, a formal legal request — including plaintiff name, legal representation details, and all supporting evidence — must be directed to:

All Drivesome trademarks, brand assets, and intellectual property are owned by Marcus Arthur Newark (or such other entity as he may nominate from time to time). Smart Business Building Pty Ltd operates the platform under licence. Any IP-related claims must be directed to the appropriate entity.
