1. Legal Entities & Ownership

Drivesome is operated by Smart Business Building Pty Ltd (ABN 65 151 489 119), registered in New South Wales, Australia ("Operator").

The intellectual property associated with the Drivesome platform, including its software, website, mobile applications, APIs, databases, documentation, branding, trademarks, domain names, and related digital assets, is owned by Marcus Arthur Newark, or such other entity as he may nominate from time to time ("IP Owner"), and is licensed to Smart Business Building Pty Ltd for the purposes of developing, operating, and commercialising the Platform.

2. Acceptance & Changes to These Terms

By using the Platform you accept these Terms. We may update these Terms at any time. We will take reasonable steps to notify you of material changes, but it is your responsibility to review the current Terms. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. If you do not agree, discontinue use.

3. Eligibility & Account Registration

Minimum age to register is 13 years. Users aged 13 to 17 require a linked parent or guardian account to be eligible for prize draws, giveaways, or any reward redemption, including any cash reward from the Creator Fund (see clause 7). Users must provide accurate, current, and complete personal information. Only one account per person is permitted. Duplicate accounts may be removed without notice. Drivesome reserves the right to refuse or terminate any account at its sole discretion.

4. DCred

DCred are non-cash, non-transferable loyalty points earned through platform activity. DCred have no monetary value, cannot be exchanged for cash, and are not refundable under any circumstances. DCred balances may be adjusted, forfeited, or voided if an account is suspended, terminated, or found to have engaged in fraudulent activity. DCred are earned through platform activity and are not purchasable for cash. Drivesome may modify the DCred earning structure, earning rates, redemption rules, reward structures, or point values at any time with reasonable notice.

DCred are entirely separate from the Creator Fund. DCred are not money and do not convert to or from the Creator Fund or any cash balance.

5. Memberships

Drivesome offers free and paid membership tiers (currently: Free, Turbo, and Twin Turbo). Paid memberships provide access to enhanced earning rates, additional giveaway entries, and other platform benefits as described on the Memberships page. Paid memberships auto-renew monthly unless cancelled prior to the renewal date via account settings. Refunds for paid memberships are not provided except where required by applicable consumer law. Membership benefits, pricing, and tier names may change. Existing subscribers will be notified of material changes no less than 14 days in advance.

6. Promotional Draws & Giveaways

Drivesome conducts promotional draws on a daily, weekly, monthly, and periodic major basis. No purchase is necessary to enter any draw. Free entry methods are available to all registered members at all times.

All draws are conducted as lawful trade promotions in compliance with applicable Australian state and territory trade promotion legislation. They are not lotteries or games of chance. Entry into draws requires completion of a nominated skill or activity component as specified for each individual promotion.

Drivesome reserves the right to substitute, postpone, cancel, or modify any prize or promotion at its sole discretion. Winners are responsible for all applicable taxes, duties, vehicle registration, insurance, transfer costs, and any other expenses associated with accepting a prize unless explicitly stated otherwise. Prizes are non-transferable and cannot be redeemed for cash. DCred converted to entries are non-refundable.

For draws with prizes exceeding $10,000 AUD in New South Wales or $5,000 AUD in South Australia, Drivesome will obtain the required trade promotion permit from the relevant authority prior to conducting the draw.

Draws are open to Australian residents by default. Where a draw is open to international participants, this will be stated in that draw's specific terms. It is the entrant's sole responsibility to ensure that participation in any draw is lawful in their jurisdiction. Drivesome accepts no liability for prizes that cannot be delivered due to legal restrictions in the winner's country of residence.

7. Creator Fund

Drivesome operates a Creator Fund that rewards creators with real money based on the genuine engagement their content receives, funded by sponsor and donor contributions. Participation in the Creator Fund, as a creator, sponsor, or donor, is governed by the separate Creator Fund Terms & Conditions, which apply in addition to these Terms. By participating in the Creator Fund you agree to those terms. Cash rewards from the Creator Fund are a form of reward redemption and are subject to the age and account requirements in clause 3.

8. User Content

Users retain ownership of all original content they submit to Drivesome. By submitting content, users grant Drivesome a perpetual, irrevocable, non-exclusive, royalty-free, worldwide licence to use, reproduce, distribute, adapt, publicly display, and promote that content in connection with the Platform and its marketing activities. Drivesome may use your username, profile image, and public activity in promotional materials without additional consent or compensation. Users warrant that all submitted content is their original work, does not infringe any third-party rights, and complies with these Terms and our Community Guidelines.

9. Prohibited Conduct

Users must not: violate any applicable law or regulation; harass, threaten, impersonate, or intimidate other users; post spam, unsolicited promotions, or repetitive low-quality content; upload malware, harmful code, or deceptive material; manipulate DCred balances, giveaway entries, Creator Fund earnings, or platform metrics through artificial means; use bots, scripts, scrapers, or other automated means to access, collect data from, or interact with the Platform; send bulk or unsolicited messages; or create, operate, or use fake, duplicate, or multiple accounts.

10. Privacy

We collect and process personal information in accordance with our Privacy Policy. By using the Platform you consent to that handling of your information.

11. Analytics & Tracking

Drivesome uses Google Analytics 4 to collect anonymised usage data. By using the Platform, you acknowledge that analytics data may be processed by Google LLC on servers located outside Australia. You may opt out via the Cookie Preference Centre or by installing the Google Analytics opt-out browser extension. Where required by applicable law, including the GDPR, analytics tracking will only be activated following your explicit consent via our cookie consent banner.

12. Third-Party Links & Services

The Platform may contain links to, or integrate with, third-party websites and services (including payment providers and sponsor links). We do not control and are not responsible for the content, policies, or practices of any third party. Your dealings with third parties are solely between you and that third party.

13. Disclaimers

The Platform is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties of any kind, express or implied, about the Platform, its availability, or its fitness for any purpose, and we disclaim all implied warranties. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

AI-assisted features (including car identification, content suggestions, and AI-generated articles and images) may produce inaccurate or incomplete results and are provided for general information only. AI output must not be relied upon as professional mechanical, legal, financial, or safety advice, and you should verify it independently before acting on it.

Drivesome is a platform that connects users and hosts user-generated content, listings, and activity. We are not a dealer, broker, agent, or auctioneer, and we are not a party to any sale, purchase, or other transaction or arrangement between users. Any dealing between users is solely between those users, and you are responsible for satisfying yourself about the other party and anything offered.

14. Limitation of Liability

To the maximum extent permitted by law, Drivesome, the Operator, the IP Owner, and their officers, employees, and affiliates are not liable for any indirect, incidental, special, or consequential loss, or for any loss of data, profits, earnings, or opportunity, arising from your use of the Platform. Where liability cannot be excluded but can be limited, our total liability is limited to AUD $100 or the amount you paid us in the three (3) months before the claim, whichever is greater. Nothing in this clause limits rights that cannot lawfully be excluded.

15. Indemnity

You agree to indemnify and hold harmless Drivesome, the Operator, the IP Owner, and their officers, employees, and affiliates from any claim, loss, liability, or cost (including reasonable legal costs) arising from your content, your use of the Platform, your breach of these Terms or our Community Guidelines, or your violation of any law or third-party right.

16. Moderation & Account Termination

Drivesome may suspend, restrict, or permanently terminate any account at any time for breach of these Terms, without prior notice or refund. All moderation decisions are final. Appeals may be submitted to [email protected] but do not guarantee reinstatement.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

18. General

• Assignment: you may not assign or transfer your rights or obligations under these Terms. We may assign ours, including to the IP Owner or a related entity, without notice.
• Severability: if any provision is found unenforceable, the remaining provisions continue in effect.
• Waiver: our failure to enforce any right is not a waiver of that right.
• Entire agreement: these Terms, together with the Creator Fund Terms, Community Guidelines, and Privacy Policy, are the entire agreement between you and us about the Platform.
• Force majeure: we are not liable for any failure or delay caused by events beyond our reasonable control.
